Do my franchise agreements need to be specific for each Middle East country in which my franchise operates? Your agreement has been drafted by US attorneys who are qualified to advise on US law. Unfortunately, US attorneys are not usually in a position to advise on the laws of other jurisdictions unless they have obtained separate qualification for that jurisdiction. It is therefore essential that your agreement is assessed by lawyers with knowledge of the law in each Middle Eastern State in which it is to be used. It is not necessary for the local lawyers advise on the commercial agreement which has been reached between the parties and recorded by the English solicitors. EU law alone cannot regulate the franchise agreements. Unfortunately there is no "international law" which can apply to agreements of this nature. They will be subject to the law in the relevant Middle Eastern State. The choice of law clause is one of the key provisions on which local legal advice is required. |
